Traineaze Privacy Policy

This privacy statement explains when and why we collect personal information, how we use it, the conditions under which we may disclose it to others and how we keep it secure.

This Privacy Statement applies to the use of our website (“Site”) and our online training software service (“Service”). It also applies to our sales, marketing, support, and customer contract fulfilment activities related to the Site and Services, and when you provide your personal information to us at a corporate event, or when applying for a job at Traineaze. By visiting and using our Site and Service you understand that you will be subject to the terms set forth in this notice.

Who is Traineaze?

Traineaze (collectively referred to as, “Traineaze”, “we”, “us”, and “our”) develops and delivers Online Training software that enables our customers to create, share and track online training with their workforce. We are located at 615 Wedgewood Dr. Woodstock, Georgia, USA.

What Personal Data Do We Collect and How Do We Collect It?

Personal data means any information about an individual from which that person can be identified. It does not include de-identified data, where the identity and identifying information has been removed.

The following personal data is collected directly from you:

  • We may collect your name, phone number, and email address, in addition to your company’s name and contact information, and other contact details that you provide by completing forms on the Site or Service. For example, signing up for the free trial, requesting a demo, or subscribing to our blog.
  • If you choose to purchase a subscription to the Traineaze Service, your payment card details are stored by our credit card processor (Stripe). We store only the last 4 digits of your card number and the expiration date.
  • We may also collect feedback, comments, questions and other information received from you in service-related communication and activities, such as meetings, phone calls, chats, social media, documents, and emails regarding the Site (or its content) or the Service.
  • Product reviews if you choose to leave a feedback on a review site.
  • A photo if you choose to upload one to your profile.
  • Information about you that you upload or submit to the Site or Service.
  • Information from any surveys that we may conduct related to the Site or Service.
  • If you apply for a job at Traineaze, we collect the data you provide during the application process.

The following information is collection from other sources:

  • We may automatically collect certain information about the devices or computer that is used to access the Site or Service through common tools, such as cookies and web beacons. This includes information from your browser or device (such as browser/device type and language), your IP address, and the actions you take on the Site and Service (such as pages viewed and the links clicked). For example, we use this information to ensure the proper functioning, security, and optimization of our Site and Service. Our use of cookies is explained thoroughly below.
  • We may obtain your name, email, and phone number from a referral.
  • We may obtain information about you from third parties, such as contractors, marketers, partners, researchers, and others.
  • We may obtain information about you from the company providing you with online training.
  • If you access the Site or use the Services through a third-party connection or log-in, you authorize Traineaze to collect, store, and use any and all information available to Traineaze through the third-party interface.
  • We also collect, use and share Aggregated Data such as statistical or demographic data for any purpose. Aggregated Data may be derived from your personal data but is not considered personal data as this data does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. This Data Use Notice does not restrict our use or disclosure of aggregated and/or de-identified information.
  • We may collect personal data if it is considered to be of legitimate interest, and if this interest is not overridden by your privacy interests. Before data is collected we make sure an assessment is made, ensuring that there is an established mutual interest between you and Traineaze.

How Do We Use Your Information?

We collect and use personal data mainly to perform direct sales, direct marketing, provide customer support, enhance our Site and Service, and to provide services request by you.

We do not send marketing emails or materials directly to individuals added to the Service to take training on behalf of our customers (a customer’s learners), unless the individual reaches out to Traineaze first and expresses interest in learning more about our Service. In other words, we do not market to your learners.

We may use your information for the following purposes:

  • Send you marketing communications which you have requested. These may include information about our products and services, events, activities, and promotions of our associated partners’ products and services. This communication is subscription based and requires your consent. You can withdraw your consent at any time. You may manage your receipt of marketing communications by clicking “unsubscribe” located near the bottom of Traineaze marketing emails or send a request to support@traineaze.com.
  • If you are registered for training on behalf of one of our customers, you may receive emails about training assignments, reminders about training that’s due, and other Service related system messages.
  • To perform services requested by you. For example, you filled out a Request Demo form, a ‘contact me’ or other web form, or sent an email requesting support related to the Site and Service.
  • If you subscribe to the Traineaze Service, we use your information to collect payment.
  • Send you information about the products and services that you have purchased from us.
  • Perform direct sales activities in cases where legitimate and mutual interest is established.
  • Provide you content and venue details on a webinar or event you signed up for.
  • Send you blog and newsletter updates that you have chosen to subscribe to.
  • Follow up on incoming requests (customer support, emails, chats, or phone calls).
  • Provide you with access, services, and emails related to a Free Trial of Traineaze that you registered for.
  • Provide access to our Customer Support website.
  • Perform contractual obligations such as order confirmations, invoices, payment receipts, reminders, and similar.
  • Notify you of Site and Service updates, policy updates, or any disruptions to our services (system messages).
  • Contact you to conduct surveys about your opinion on our products and services.
  • To administer, protect and improve our business and our Site and Service, including: troubleshooting, data analysis, testing, system maintenance, support, data analysis, reporting and hosting of data.
  • To deliver relevant website content, online advertisements and information for you; and measure the effectiveness of the advertising provided.
  • Use data analytics to improve our website, products, services, marketing, customer relationships and experiences; and for market research, statistical and survey purposes.
  • For hosting purposes related to the Site and Service. For example, if you are our customer, we may collect and host your data to provide Services to you. If your employer is our customer, we may process your data in accordance with providing Services to them. However, we will not review, share, distribute, or reference any such data except as provided in a services agreement between us and our customer, or as may be required by law. Data processing for the purpose of hosting our Services is a legitimate business interest.
  • Process a job application.

Our Legal Basis for Collecting Personal Data

We will only collect and process your personal data where we have a legal basis to do so. The legal basis for our collection and use of your personal data varies depending on the manner and purpose for which we collected it.

We will only collect personal data from you when:

  • We have your consent to do so, or
  • We need your personal data to perform a contract with you. For example, to process a payment from you, fulfil your order or provide customer support connected with an order, or
  • The company providing you with training provides us with your information for training purposes, or
  • The processing is in our legitimate interests and not overridden by your rights, or
  • We have a legal obligation to collect or disclose personal data from you.

Do We Share Your Data with Anyone?

We may disclose and share your personal data with the parties set out below:

  • Where you have consented for us to do so. For example, if you have consented to receive marketing materials from third parties, or in respect of third parties’ (including co-branded or jointly promoted) products and services, we may pass your data on to the relevant third parties for the purpose of sending you such marketing communications.
  • To business partners, suppliers, sub-contractors and other third parties that we use in connection with the running of our business for the purposes set out in the in the section ‘How we use your data’, such as:
    • Third party service providers that we engage to provide IT systems and software, and to host our Site and Service;
    • Third-party payment processing services (including Stripe) to process your payment to us. We do not store your credit/debit card information;
    • Third party software we may use to operate Traineaze, such as CRM and customer service software.
    • Updating marketing lists, data analytics, advertising, market research, participation in a contest or survey, and sending and receiving communications.
    • Third party service providers that we engage to send emails and postal mail on our behalf including in relation to marketing communications, to provide data cleansing services and to provide marketing and advertising services;
    • Analytics and search engine providers that assist us in the improvement and optimization of our website;
    • Affiliate networks through whom you have accessed our website;
  • To any third party to whom we may choose to sell, transfer, or merge parts of our business or our assets. Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.
  • To protect our customers and website from fraud and theft, we may share personal data that is required to make identity checks and personal data that we obtain from making identity checks, together with account information, with organizations (including law enforcement agencies), involved in fraud prevention and detection and credit risk reduction. Please note that these third parties may retain a record of the information that we provide to them for this purpose.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation.
  • To our professional advisers including lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance and accounting services.

How Long Do We Keep Your Personal Data?

We store personal data for as long as we find it necessary to fulfill the purpose for which the personal data was collected, while also considering our need to answer your queries or resolve possible problems, to comply with legal requirements under applicable laws, to attend to any legal claims/complaints, and for safeguarding purposes.

This means that we may retain your personal data for a reasonable period of time after your last interaction with us. We may process data for statistical purposes, but in such cases, data will be anonymized.

How Do We Keep Your Data Secure?

We have appropriate organizational safeguards and security measures in place to protect your data from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed.

The communication between your browser and our website uses a secure encrypted connection wherever your personal data is involved.

Although we will do our best to protect your personal information, we cannot guarantee the security of your data transmitted to our website and any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorized access.

In the unfortunate event of a personal data breach, we will notify you and any applicable regulator when we are legally required to do so.

Links to Other Websites and Third Parties

Our Site and Service may include links to and from the websites of our partner networks, advertisers and affiliates, or to social media platforms. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to their websites.

Public Community Forums and Social Media

We may provide message forms, comment forms, blogs, product reviews, or chats through the Site and Service. Any information you submit to these may be read, collected, or used by others who visit these forums. We are not responsible for the information you choose to submit in these forums. We are not responsible for the privacy policies or the content of such sites.

If you upload photos or videos, add posts or comments, etc. on our social media sites or product review sites, the information can be read by anyone with access to these sites and used for purposes over which Traineaze has no control. Therefore, Traineaze is not responsible for any information you submit to social media sites.

Customer Testimonials

Traineaze displays a list of customers and testimonials on our Site. These testimonials may contain information such as the names and titles. We obtain the consent of the individuals prior to posting such information or testimonials.

California Privacy Rights

California law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed. If you are a California resident and would like to request this information, please provide a written acknowledgement that you are a resident of California and send your request to the address located in the How to Contact Us section of this policy.

Do Not Track

Your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit. There is no consensus among industry participants as to what “Do Not Track” means in this context. Like many websites and online services, Traineaze currently does not alter its practices when it receives a “Do Not Track” signal from a visitor’s browser. Children

Our Site and Service do not target and are not intended to attract children under the age of 13. We do not knowingly solicit personal information from children under the age of 13. Should we learn or be notified that we have collected information from users under the age of 13, we will immediately delete such personal information. If you are under the age of 13, you are not permitted to use or submit your data to the Site or Service.

How You Can Access and Update Your Information

You may view and update certain personal information by logging in, as applicable, to the relevant portions of the Site or Service, or by contacting support@traineaze.com.

If you are a customer, or a user taking training on behalf of an organization and have questions or concerns about your personal data in regards to the service, please contact the organization providing you with training.

The Use of Cookies and Beacons

A cookie is a small text file that is stored in your web browser that allows Traineaze or a third party to recognize you. Cookies might be used for the following purposes: (1) to enable certain functions; (2) to provide analytics; (3) to store your preferences; and (4) to enable ad delivery and behavioral advertising.

Cookies can either be session cookies or persistent cookies. A session cookie expires automatically when you close your browser. A persistent cookie will remain until it expires or you delete your cookies. Expiration dates are set in the cookies themselves; some may expire after a few minutes while others may expire after multiple years. Cookies placed by the website you’re visiting are sometimes called “first party cookies,” while cookies placed by other companies are sometimes called “third party cookies.”

How We Use Cookies

When you use the Traineaze Site or Service, Traineaze or a third party may place a number of cookies in your browser. Some of the cookies will only be used if you use certain features or select certain preferences, and some cookies will always be used.

Each cookie serves one of four different purposes:

Essential Cookies
These first party cookies are essential to the use of the Traineaze Service. For example, we may use these cookies to store your session information to keep you logged in, prevent others from changing your password without your username and password.

Analytics Cookies
These cookies track information about how the Traineaze is being used so that we can make improvements and report our performance. We might also use analytics cookies to test new ads, pages, or features to see how users react to them. Analytics cookies may either be first party cookies or third party cookies.

How do third parties use cookies on Traineaze?

Third party companies like analytics companies and ad networks generally use cookies to collect user information on an anonymous basis. They may use that information to build a profile of your activities on the Traineaze Site and Service and other websites that you’ve visited. What are my cookie options?

What about Web Beacons?

We use additional technologies to help track user activities and preferences. For example, we use web beacons (also known as clear gifs, pixel tags or web bugs). Web beacons are tiny graphics (about the size of period) with a unique identifier that are embedded invisibly on web pages or emails. They are used to track user activities and communicate with cookies. You cannot opt out of web beacons used in webpages, but you can limit their use by opting out of the cookies they interact with. You can opt out of web beacons used in emails by setting your email client to render emails in text mode only.
